Sparex Australia Terms & Conditions of Trade


Return of saleable goods


Parts Return Procedure (Use Authority to Return Parts Form) - Click here for returns under warranty and click here for all other returns. Alternatively, fill out the online form below:

Parts return requests must be submitted using the Sparex Australia Pty Ltd “Authority to Return Parts” Form. Parts must not be returned without prior approval.

Parts returns will only be accepted up to 28 days after the invoice date. All parts ordered in error by the dealer will incur a 20% re-stocking fee.

Important Notes

Prices need to be checked prior to ordering. Return requests involving pricing issues will be rejected.

Parts ordered in error by the dealer will not be considered for return if under $25.00 at the dealer net price.

The following parts are non-returnable:

Specially Procured or Bought to Order Parts
Toys and Promotional Merchandise
Aerosols, Batteries and Lubricants
Incomplete or opened kits
Parts that are obsolete or considered to be no longer available
Any parts that have been superseded or replaced
All perishable items such as hoses or loctite sealants
All backordered parts
The decision of Sparex Australia Pty Ltd in all Parts Return request applications is final.

 

Handling Charges

With the exception of goods shipped in error by Sparex, a 20% handling charge capped at a maximum of $250.00 per line will be applied to all returned goods. Freights costs for parts returns are the responsibility of the dealer.

All Parts returned without prior approval will be returned to the dealer at the dealer’s cost.

 

Dealer Action

Complete in full, all sections of a Authority to Return Form. A full detailed explanation giving the reason for the return is required. If an agreement is made with any Sparex employee regarding the return of goods, details and names must be advised. Please note only Sparex Customer Service Staff are authorized to approve parts return requests.

A copy of the completed Request for Return Form should be faxed to Sparex Australia Pty Ltd for approval and a copy retained for your records.

 

Sparex Action

On receipt the request will be considered. A copy will returned to the dealer by fax within 2 working days with our decision. A tick in either the Accepted Y/N box will indicate acceptance or rejection of the request. Any handling charges to be applied will also be advised.

 

Dealer Action

Return the accepted goods to your local Sparex warehouse enclosing a copy of the approved Authority to Return Parts Form as a packing note.

Note: Goods must be returned within 21 days of approval being received by the dealer. Any parts returned after 21 days from the date of approval to return will incur an additional 10% re-stocking charge or the return may be declined.

All goods must be in the original packaging and be in a new mint saleable condition. Credit will not be issued on damaged or unidentified goods.

Payment


30 days net or as otherwise agreed. Sparex Australia Pty Ltd reserves the right to place overdue accounts on hold.


Minimum order quantities


This applies to many of our low value items and will automatically be applied. If orders are received for lower quantities we reserve the right to supply and charge for the minimum quantity without prior notification. Our minimum invoice charge is $ 10.00 excluding Freight and GST – All orders under the minimum invoice charge will incur a balance charge to reach minimum invoice value.


Prices


Please refer to the Sparex Australia Pty Ltd website for all current pricing. All website nett prices quoted exclude GST. All website Recommended Retail Prices (RRP) quoted exclude GST. We reserve the right to alter any published price at any time without prior notice. All parts are sold at our published prices unless any variation from this has been agreed with Sparex Australia Pty Ltd before an order is placed.


Back orders


Please check undelivered back orders and advise us in writing if you wish to cancel any. Where possible back orders will be shipped with other goods to minimise freight charges.


Cancellation


Cancellation of an order must be made in writing prior to despatch.

Shortages and Damages


Sparex Australia Pty Ltd must be notified of shortages or damages to orders within 7 days of receipt of goods.


Non Delivery

 

Non-receipt of the entire consignment must be notified within 7 days of the invoice date.


Pricing Errors


Any errors in pricing/discount applied are to be advised within 7 days of the invoice date.

Please note that claims submitted outside the above periods will be refused.


Liability


We fully guarantee all items shown in Sparex Australia Pty Ltd products against faulty materials or workmanship. If any fault due to bad workmanship or materials is proved and the details notified to the company within twelve months of purchase, the company will at its own cost and its own option repair or replace the faulty article but subject to this all express or implied warranties or conditions as to quality or fitness for any purpose of the goods are hereby expressly excluded. It is the responsibility of the installing engineer to check components before and during installation. We will not accept any labor charges in relation to replacing Sparex parts replaced under warranty. We will not accept under any circumstances liability for consequential loss or loss of profits arising on any contract.


Retention of title


The legal and equitable title in the goods whether stored separately or as part of an assembly shall remain with Sparex Australia Pty Ltd until the price and all other sums owing by the customer to Sparex Australia Pty Ltd are paid in full, but after delivery the customer shall be responsible for and shall indemnify Sparex Australia Pty Ltd against loss or damage to the goods from whatsoever cause occurring.


General


All contracts between Sparex Australia Pty Ltd and its customers are in accordance with Australian Law and shall be governed by the above terms of trade which replace and override all other terms of trade.
