Privacy Policy

This Privacy Policy is provided by Sparex Limited (“Sparex”) and its subsidiaries and affiliates (as identified in the table in Appendix 2 (together “Sparex”, “we” or “us”) and largely refers to the collation and handling of data on Sparex websites (see Appendix 2 for details of such websites). Capitalised terms not defined in the body of this Policy are defined in the Glossary at the end of this Policy (See Appendix 1).

This Privacy Policy tells you what information is collected from you from Sparex, or that you may give to us, together with how the information is collected, and how the information will be Processed by us. Please ensure that you have read this Policy and that you understand how data is collected from you. Sparex encourages you to regularly review this Policy as it may from time to time change and be updated.

Sparex may collect and Process the following data about you:

Information you give us

You may give us information about you by filling in forms on Sparex websites or by corresponding with us by phone, e-mail or otherwise. This includes information you provide if you register to use Sparex websites, subscribe to our service, search for a product, place an order on Sparex websites, enter a competition, promotion or survey, and when you report a problem with Sparex websites. The information you give us may include your name, address, e-mail address and phone number.


Information collected from you

With regard to each of your visits on Sparex websites: the following data may be automatically collected from you:

Technical information, including the Internet Protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; and Information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from Sparex websites (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.


Third Party Services

Sparex also uses third party software providers Mailchimp and ZOHO. MailChimp is used to send promotional e-mails and ZOHO is used to capture 'Return Requests' using an embedded form. These third party providers may store your Personal Data on their own secure servers (these servers may be outside of the country in which you originally provided your data) and only use this information to fulfil the specific requirement of Sparex.


How information collected from you is used

Information held about you may be used by Sparex in the following ways, as permitted by Applicable Laws:

  • We have a legitimate interest in carrying out the Processing (including our legitimate interests in operating our business, providing goods and services to you, alerting you to other products or services that may be of interest to you, and maintaining or improving our products or services), and there is no undue risk to your rights, freedoms or interests
  • The Processing is necessary in connection with a contract entered into with you, or for your benefit
  • The Processing is required by Applicable Laws
  • The Processing is necessary to protect the vital interests of any individual
  • Any other lawful basis available under Applicable Laws.

International transfer of Personal Data

We may make use of processing facilities controlled or operated by members of our corporate group, which are located in jurisdictions other than the jurisdiction in which your Personal Data were originally collected. In particular, e-mail details, the content and features of a Site, an App, or a Device may be provided by means of servers located outside your jurisdiction (including, but not limited to, servers located in the United States). Your Personal Data may be transferred to, and Processed using, those servers or other Processing facilities, as part of the operation of a Site, an App or a Device, or in connection with any of the Processing purposes set out in this Statement, subject always to compliance with the provisions of Applicable Laws (e.g., by implementing EU Standard Contractual Clauses, where appropriate). Data Retention

We will only retain your Personal Data for as long as we require such Personal Data in connection with the purposes set out in this Privacy Policy. We may also be required to retain your Personal Data for additional periods of time, for example, where required to do so by Applicable Laws.

Sparex offers data subjects the opportunity to define, during their lifetime, the instructions that should be followed after their death with regard to their Personal Data. Should the data subject pass away without leaving clear instructions about how to manage their Personal Data, we can also work with immediate family members and representatives to remove Personal Data of a deceased person where appropriate. In certain circumstances, we may provide beneficiaries of deceased data subjects with reasonable information on the data held about the deceased data subject by Sparex. We shall not provide passwords or other login details. Any decision to respond to a request regarding a deceased data subject will need to be balanced against the obligation to keep information secure, safe, and private.


Protection of your Personal Data

All information you provide to us is stored on our secure servers or on secure servers operated by a third party. Where you have been provided (or where you have chosen) a password which enables you to access certain parts of our websites, you are responsible for keeping this password confidential. Do not share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although robust systems are in place to protect your data Sparex cannot guarantee the security of your data transmitted to Sparex websites; any transmission is at your own risk.
